In compliance with Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights, Duñach S.A. Corredoria d’Assegurances is responsible for the processing, informs you that your data will be used for the purposes ofInsurance services: advice on taking out insurance policies, objective risk analysis, management of policy cancellations, sending out quotations and commercial insurance offers, general marketing and advertising activities, assisting and helping insurers to manage claims suffered by customers during any claims caused, the legal basis for such processing being the performance of a contract and the consent of the data subject.
In order to achieve this objective, your data may be communicated to: insurers, tax authorities, banks, savings banks and rural authorities; notaries, lawyers and public prosecutors; companies and professionals who offer their services for handling and settling claims; distributors and advertising managers and the relevant public authorities.
Its data will be kept during the period of validity of your contracts and once cancelled, for 6 years in accordance with Art. 30.01 of the Commercial Code, or 10 years for life insurance and pension schemes, as provided for in the legislation on the prevention of money laundering and the financing of terrorism.
Any person has the right to request access, rectification, cancellation, limitation of processing, opposition or the right to portability of their personal data, by writing to our address Duñach S.A. As brokers, we are the only professionals able to advise, from complete independence, impartiality and objectivity, based on an objective risk analysis, and we must assert your legitimate interests to the insurers, representing you, but at the same time, by owing allegiance to the other part of the contract.
We do not hold any equity participation with any insurer, or financial entity, nor do they have any involvement in the Brokerage.

12) REMUNERATION:
Both in periodic and extraordinary premiums, it will be for commissions, included in the premium receipt, which will be borne entirely by the insurer, and not charged to you, with the exception of fees by express agreement or indication..

Quality that differentiates Brokers, as established in art. 175 of RDL 3/2020 and that results in the cost of insurance, being more economical, since the best price will be obtained thanks to the quotation research service and the negotiations carried out by the Brokerage to place the risk.
The objective analysis is the sum of commissioned work task, and the additional value of our professional knowledge to assess, in a precise and reliable manner with the risks and coverage that are related to your activity.
In addition to this analysis of the risk and its insured needs, this objective analysis is not limited to a cursory examination of the product itself, but also contrasts other factors that the insurer confers such as –quality of service, patrimonial and financial situation, human resources and technology, established field, specialized ranking, perspectives, etc., which frees you of complex comparisons, benefiting you in the selection of the most suitable policy, and one which is closest to your demands and needs.
14) CHARACTERISTICS OF OUR ATTENTION:
We prefer the personal and direct treatment. It generates calm and confidence. We offer this service and attention in our branches, also by phone or electronic media.

Relations between Duñach S.A. Corredoria d’Assegurances and its customers are subject to Spanish law and jurisdiction.
16) REPRESENTATION:
I authorise Duñach S.A. Corredoria d’Assegurances as an exclusive mediator in relation to the assurance of the risks described in the recommended application, from this moment, especially in the case of expiration or cancellation, unless otherwise indicated or revoked, a designation that the broker accepts.
In any case it will require the express consent of the applicant to sign a new contract or to amend or terminate the contract of insurance currently in force.
17) INACCURATE STATEMENT:
The applicant declares that the information provided is truthful, accurate, complete and current, and is responsible for the inaccuracies of same, and will be obliged to report any significant change in the circumstances of their risks occurring during the term of the insurance. The criterion of good faith must always prevail.
In order to minimise or exclude errors, please check all information contained in the documentation of insurance.
18) PROVISION OF SERVICES:
Your contract through us provides:
- Quality and full security guarantees for being a legally regulated figure and our activity is subject to permanent control.
The Brokerage, unlike agents, is free and independent, and offers independent, professional and impartial advice and act as an intermediary, using our expertise in risk and insurance, with comparative analysis in searching and formulating a proposal, and assisting the client to choose the coverage that is reasonably suitable for their requirements and at the right price. - Permanent assistance, representing the client in subsequent stages, especially in the event of an accident by checking progress and watchful that insurers fully comply with their obligations.
To exercise our broker activity and insurance brokerage requires special skills and knowledge, honesty and professionalism. Our obligations are:
1) Providing sufficient and accurate information.
2) Conducting the business of mediation without maintaining ties with insurers.
3) Providing independent advice, both professional and impartial.
4) Reporting on the conditions of the contract, according to our market knowledge, experience and professional knowledge, to agree to subscribe, and provide the best coverage in the interest of the client.
5) Ensuring the concurrence of the requirements to be fulfilled by the insurance policy to its complete effectiveness.
Providing the policyholder, insured or beneficiaries of insurance claims, information on any clause of the policy. In the case of accident occurred during the term of the policy, we will provide assistance and diligent advice, clearly, quickly, and efficiently, informing Clients of their rights and obligations.
6) Defending the interests of the client with responsibility, truthfulness and commitment, and proposing effective solutions.
Specifically, the service which we are assigned to do, is everything possible to meet the insured needs of the Client, although it does not contain an express mandate to mean what must be obtained inevitably. Our responsibility is of means, not of results.
Although the Broker displays his operations to arrange cover and the applicant indicated his unilateral intention to the commission, it will be agreed expressly, that the mere receipt of the order is not a contractual acceptation – not even temporarily, until the policy of insurance in this respect fulfils all requirements necessary to take full effect.
Relationship Client/Insurer: The Broker assesses, in order that they can conclude a contract, but is not answerable to the decisions of the insurer.
The applicant’s subsequent actions if the contract is concluded, confirms receipt and acceptance of this present information.
In the event that the subscriber’s subsequent proposal was not, for whatever reason, completed within seven days from this date, this order shall be rescinded and resolved any pre-contractual or contractual agreement caused by the same between subscriber and the Brokerage.
